ORDERING POLICIES - TERMS AND CONDITIONS OF USE

Products - All food products are packaged in plants that handles milk, wheat, eggs, soy, and tree nut products. Customers assume all liability for any dietary restrictions or allergies. All customers accept complete responsibility for product selection, storage, inspection, ingredients, dietary needs or special dietary restrictions.

Cancellation - Order cancellations MUST be done in writing (email) before shipment has occurred, once an order has shipped no cancellations are allowed. Fee: If paid by credit card, cancelled orders are charged 3% of the order total (deducted from the refund) for the merchant fees we have to pay on all credit card transactions. There is no cancellation fee if paid by check or money order. Refunds are paid back to you in the same form of payment used for the order (credit card or by check / money order).

Damaged Items - Items damaged in shipment are usually replaced at no charge to you. All damaged products must be returned. The shipper (usually UPS or FedEx) must be notified at the time of product receipt of any noticable damage. We must also be notified within ten days of the receipt of the shipment of any damage. Do not attempt to file a damage claim with the shipper, we must handle any damage claims from here (this is required by both UPS and FedEx). We will request photographs of any damaged items (required). Non-cooperation with the claims process will result in a claim denial and/or no product replacements.

Order Corrections - Corrections can be made before the order ships (no charge). If you need to change the delivery address or delivery date, you must call us or email us first before we ship so we can get this done in a timely fashion. UPS now charges $21 per package for address / intercept corrections if your order is already shipped and enroute. Freight shipments are charged $36 for a corrected Bill of Lading (for example, change of address). The correct name and address for your shipment is essential. Examine the order receipt (sent by email) for name and address accuracy.

Hawaii, Puerto Rico, Virgin Islands, Overseas - NO shipments or orders to these locations. Alaska orders can be shipped by barge (ship) to Alaska (inquire via email).

Delivery - We are not responsible for any delivery delays, as this is all in the hands of third-party delivery providers (US mail, FedEx, UPS and freight delivery providers). Weather interuptions, road conditions, natural disasters and other circumstances can occur at any time, any where. We will gladly assist with shipment information and any delivery problems that may arise. Customers are responsible for ensuring that they are available to receive their shipments and packages from any of the delivery companies and providers utilized.

Payment - All orders must be prepaid in advance. We accept Visa, Mastercard, Discover, American Express, PayPal and check / money orders from a US bank.

Returns - Any products returned, refused or failure to pick up, are considered "cancelled" and the Cancellations terms and fees will apply, including any return shipping costs. All sales are final. This is also the policy of the suppliers and canneries we deal with.

Missing Item Refunds - Missing items are usually refunded or reshipped after we receive the shipping invoice data for your order. We can expedite this on request.

Missing Items - Missing items must be reported in writing (email) within 10 days of receiving shipment (no exceptions). We may require a complete inventory of all items received so we can accurately cross check the shipping records, including shipping weight and box inventories. Please be sure to actually unpack and inspect the contents of each box before contacting us about missing items.

Overshipments - Any products received that are not part of the order must be returned or paid for. Return shipping costs for overshipments returned to us are reimbursed to you (credited to your credit card in most cases), or we can issue a shipper call tag and have the products picked up.

Back Orders - No back orders on freight shipments (semi-truck), missing items are refunded. Rainy Day UPS shipments will ship backorders when products become available.

Charge Back - Credit card charge backs are handled in accordance to our Cancellation terms and fees. Orders are automatically cancelled upon credit card charge back. Any unpaid items received must be returned at customer expense; or otherwise paid for. Any amounts still owed for products, shipping costs incurred will be collected in accordance to our Cancellation terms and State law, including Cancellation fees.

Pricing - Pricing on the website are current prices. We receive emergency price increases from canneries at any given time, especially during times of crop failures or national / regional emergencies or product shortages. Prices and descriptions on our website are subject to change without notice. We honor all prices as-sold on current orders.

Shelf Life - Shelf life estimates are based on industry sources deemed reputable. We have no control over individual storage practices or locations, and disclaim any liability or warranty for particular results or storage and environmental conditions.

Website - Product description, pricing and availability as shown on the website are subject to change without notice. We do not accept any responsibility for manufacture changes to product descriptions, pricing, weights, sizes, or the availability of ingredients.

Communications - Use of our website, including product orders, email sent to us, authorizes Food Assets to send communication emails, sale notices and relevant information about our products to the email address provided. Opt-out is always provided. We do not sell, share or trade your personal information, including email with anyone. We have only sent one "sale notice" is 28 years, so we are not going to be bothering you.

We reserve the right to refuse or cancel orders from anybody for any reason.
